I've paid the 4.2% for my villa building licence is there anything else to pay the Townhall?

Yes, The townhall will also ask for a holding deposit for damage that may be caused to council property during the build.For villas up to €300 K it is €3000 while villas from €300k-€600K is €4,200. This deposit will be paid back when the townhall has inspected the site to ensure no damages have been incurred?

I am planning to tile my garden, do I need a licence?

Yes, and should not you  start without one as if you are caught by a townhall offical there will be a fine.

As a seller what taxes do I have to pay?

This is not a simple question to answer as the Captial gains tax on property is currently running at 18 per cent. It used to be 35 per cent for non residents and 15 % for residents but that changed a few years ago. If you are selling and are a non-resident the buyer will pay 3 per cent of the purchase price directly to the Tax office to cover your capital gains tax. As a seller you are also responsible for the plus Valia tax which is a tax set by the local authorities on the increase in value of your property from when you bought it to the time of sale ( this is according to the local authorties values and not the market values). In some sales agreements however the buyer agrees to pay the Plus Valia ( however by law the seller should pay it).

How much is a building licence in Ayamonte?

The Townhall in Ayamonte will charge you 4.2 per cent of the amount that the builder has quoted to build your villla or property to grant you a building licence. You must first pay the amount and then wait for the approval with signed document.

What's a NIE?

NIE (Numero de Identificación de Extranjero) your Fiscal number in Spain.

The NIE is necessary for almost any official transaction you may want to do in Spain. This tax identification number may be obtained by bringing a photocopy of your passport to the nearest department for Foreigner's and filling out the appropriate form. Between 10-14 days later you will be issued your NIE which you must collect from this department.

Huelva is the nearest office in this area and to avoid long queues and complications it is advisable to leave this chore to your lawyer.

Note: As of March 2010, I have noticed that getting your NIE for the purpose of buying a property in Huelva has been improved. Now you can present the paperwork, pay the adminsistration fee at the nearest bank and come back and collect your new NIE all in the same day. Please note that this is for the NIE not your residency card.
